Terms & Conditions
These Terms govern your use of PSquare Billing. Please read them carefully before using the application.
1. Acceptance of Terms
By downloading, installing, accessing, or using the PSquare Billing application (“App”, “Service”), you (“User”, “Administrator”, “Operator”) agree to be legally bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms in full, you must immediately cease use of the App and uninstall it from your device.
These Terms apply to all users of PSquare Billing, including business administrators, staff operators, franchise owners, and franchise staff.
2. Eligibility & Account Registration
Business Entities Only
PSquare Billing is designed exclusively for registered businesses, garages, franchise networks, and commercial entities. Individual personal use is outside the intended scope.
Age Requirement
You must be at least 18 years of age to create an account and have the legal authority to bind your business to these Terms.
Account Creation
Provide accurate registration information, keep your credentials confidential, and immediately notify us at psquareautomotive@gmail.com if you suspect unauthorized access.
Accuracy of Information
You are solely responsible for ensuring all business information, GSTIN details, addresses, and contact data entered into the App is accurate and up to date.
3. License & Permitted Use
PSquare Billing grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App solely for your internal business operations, subject to compliance with these Terms.
Restrictions — You may not:
- ✕Copy, modify, distribute, sell, sublicense, or resell the App or any portion of it.
- ✕Reverse engineer, decompile, or attempt to extract the source code.
- ✕Use the App to build a competing product or service.
- ✕Share account credentials with persons outside your authorized business team.
- ✕Use automated scripts, bots, or crawlers to interact with the App.
- ✕Attempt to gain unauthorized access to any other business's data.
4. Account Roles & Responsibilities
PSquare Billing operates on a multi-role access model:
Admin
Full control over the business workspace — billing, settings, staff, inventory, and reports.
Staff
Operational access assigned by Admin — billing and inventory functions.
Franchise Owner
Manages a franchise unit linked to a parent business.
Franchise Staff
Operates under a Franchise Owner's scope.
Administrator Responsibility: The Admin account holder is responsible for all activity performed under their business workspace, promptly revoking access for departed staff, and ensuring their team uses the App in accordance with these Terms.
Franchise Relationships: PSquare Billing is not a party to any franchise agreement between a franchisor and franchisee and bears no liability for disputes arising from such relationships.
5. Billing, Payments & Subscriptions
Free & Paid Plans
PSquare Billing may offer free access tiers and paid subscription plans. Features available under each plan will be communicated within the App or official communications.
Payment Terms
Subscription fees are billed in advance on a recurring basis (monthly or annually). All fees are in INR inclusive of applicable GST. We do not store your payment card details.
Refund Policy
Subscription fees are non-refundable except where required by law or at our sole discretion in exceptional circumstances. Incorrect charges must be disputed within 7 days.
Price Changes
We will provide at least 30 days' advance notice of any price change. Continued use after the effective date constitutes acceptance of the new pricing.
6. Data Ownership & Intellectual Property
By using the App, you grant PSquare Billing a limited, non-exclusive license to store, process, and display your data solely for the purpose of delivering the Service. This license terminates upon account deletion, subject to legally mandated retention obligations.
All software, interfaces, designs, logos, trademarks, and content owned or created by PSquare Billing are the exclusive intellectual property of PSQUARE Automotive Studio. You may not use, reproduce, or distribute any of our intellectual property without prior written consent.
Any suggestions or feature requests you provide may be used by PSquare Billing to improve the Service without any obligation to compensate you.
7. Acceptable Use Policy
You agree not to use PSquare Billing to:
- 1Generate fraudulent invoices or misrepresent financial records.
- 2Store or transmit data that is illegal, defamatory, obscene, or in violation of any applicable law.
- 3Conduct any activity that violates Indian tax law, GST regulations, or other applicable regulatory frameworks.
- 4Attempt to compromise the security, integrity, or availability of the App or its servers.
- 5Upload malicious files, viruses, or software intended to damage the Service or other users.
Violation of this policy may result in immediate account suspension or termination without notice or refund.
8. Third-Party Services
Integrations
PSquare Billing relies on trusted third-party providers for hosting, database services, file storage, and transactional email — all bound by their own terms.
No Endorsement
References to third-party services within the App do not constitute an endorsement. We are not responsible for their content, reliability, or practices.
External Links
The App may contain links to external websites. We are not responsible for the availability, accuracy, or content of those external resources.
9. Disclaimers & Limitation of Liability
PSquare Billing is provided on an “as is” and “as available” basis. We make no warranties regarding uninterrupted availability, error-free operation, or accuracy of generated reports or invoices.
PSquare Billing is a billing assistance tool, not a substitute for qualified financial, accounting, or legal advice. You are solely responsible for verifying accuracy of all bills, GST calculations, and financial records.
We shall not be liable for:
- —Loss of business data, revenue, profits, or goodwill.
- —Indirect, incidental, consequential, or punitive damages.
- —Damages from unauthorized access due to your failure to secure credentials.
- —Service interruptions due to force majeure events (natural disasters, internet outages, third-party failures).
Our total cumulative liability shall not exceed the amount you paid to PSquare Billing in the 3 months preceding the event giving rise to the claim.
Indemnification: You agree to indemnify and hold harmless PSQUARE Automotive Studio and its personnel from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of third-party rights.
10. Termination
Termination by You
Submit a deletion request to psquareautomotive@gmail.com. Your account and data will be permanently purged within 30 days, subject to legally mandated retention obligations.
Termination by Us
We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the Service entirely.
Effect of Termination
Your license ceases immediately. Provisions that by their nature survive termination (including Sections 6, 9, and 11) will continue to apply.
11. Dispute Resolution & Governing Law
These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and other applicable Indian statutes.
Any disputes shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra.
Informal Resolution First
Before initiating any legal proceedings, you agree to first contact us at psquareautomotive@gmail.com and provide us 30 days to attempt an informal resolution.
12. Changes to These Terms
We reserve the right to update or amend these Terms at any time. When changes are made, the “Last Updated” date will be revised. For material changes, we will notify registered users via email or in-app notification at least 14 days before the changes take effect. Continued use of the App after the effective date constitutes acceptance of the revised Terms.
